The ruling of United States v. Nixon established a
constitutional basis for executive privilege. Executive privilege is not something
mentioned in the Constitution but it has been used by Presidents several times to keep
government secrets confidential and protect communications between those who constitute
the government. The Supreme Court ruling in the constitution United States v. Nixon held
that the President is not immune from the judicial
process.
Executive privilege provides the President a
certain degree of freedom but only if they can prove that its use involves matters of
national security or very sensitive information. If the President is subpoenaed by the
courts for an investigation the President would have to disclose all the required
evidence. Basically it meant that no man was above the law.
